TERMS AND CONDITIONS

1. ABOUT US
JP Landscaping is the trading name of JP Landscaping & Fencing Ltd ("we," "us," "our"). These Terms and Conditions apply to all work undertaken by us for clients ("you," "your"). We are a professional landscaping and fencing company with nearly 20 years of experience, based in Dorset, England.
By accepting our quotation or commissioning our services, you agree to be bound by these Terms and Conditions.
2. SERVICES
2.1 We offer a wide range of landscaping and fencing services including but not limited to:
• Patios and paving
• Fencing and gates
• Decking
• Retaining walls
• Garden landscaping and design
• Turfing
• Driveways
• Garden buildings and structures
• General groundwork
2.2 All services will be carried out with professional care and attention to detail, using quality materials and workmanship.
3. QUOTATIONS AND ESTIMATES
3.1 We provide either quotations or estimates of costs for work and this will be stated on the information provided. These are valid for 30 days from the date of issue unless otherwise stated.
3.2 Quotes (or quotations) and estimates are based on the information given and site conditions known at the time of survey. Quotes would be a fixed price for the work stated, whereas estimates can fluctuate, but would be more accurate and often cheaper than a specified quote. Estimates are preferred for many jobs as more often than not, designs and customer preferences can alter during construction. While we strive to provide accurate pricing, we will endeavour to discuss and be clear if changes to quotes and estimates occur during the job.
3.3 Final costs may vary from the original estimate due to factors including but not limited to:
• Unforeseen ground conditions (such as poor soil quality, hidden obstructions, or unexpected levels of groundwork required)
• Discovery of underground services not previously identified
• Hidden structural issues or complications
• Changes in material availability or pricing
• Additional work requirements that become apparent during the project
• Weather-related complications requiring additional measures
3.4 We are committed to transparent pricing and will communicate any anticipated cost variations to you as soon as they become apparent. We will seek your approval before proceeding with any work that will result in significant additional costs beyond the original estimate.
3.5 For larger projects, we may provide a detailed breakdown of costs to help identify areas where variations might occur.
3.6 Quotations do not include:
• Work not specifically mentioned in the quotation
• Removal of asbestos or other hazardous materials
• Work required due to building regulations that were not apparent during the initial survey
• Costs arising from third-party requirements or delays
3.7 All prices quoted are in British Pounds Sterling (GBP) and include VAT where applicable.
4. ACCEPTANCE AND COMMENCEMENT
4.1 Acceptance of our quotation may be made verbally, in writing, by email, or by payment of the deposit.
4.2 We will endeavour to provide realistic timeframes for work commencement, but these are estimates only. Start dates may be subject to change due to weather conditions, material availability, or unforeseen circumstances.
4.3 We will keep you informed of any changes to agreed schedules as soon as reasonably possible.
5. PAYMENT TERMS
5.1 Payment terms will be specified in your quotation and may include:
• A deposit payment before work commences (typically for material costs)
• Stage payments for larger projects
• Full payment upon completion for smaller projects
5.2 Payment is due within 7 days of invoice unless otherwise agreed in writing.
5.3 We reserve the right to suspend work if payments are not made in accordance with the agreed terms.
5.4 Accepted payment methods include bank transfer, cash, and cheque. Payment details will be provided on your invoice.
5.5 Title to materials and goods shall remain with JP Landscaping & Fencing Ltd until payment has been received in full.
6. VARIATIONS AND ADDITIONAL WORK
6.1 Any variations to the agreed work must be agreed in writing and may result in additional charges.
6.2 We will inform you of any additional costs arising from unforeseen circumstances before proceeding with the work.
6.3 You have the right to refuse additional work, but we cannot be held responsible for any consequences of work left incomplete as a result.
7. SITE ACCESS AND CLIENT RESPONSIBILITIES
7.1 You must provide clear and safe access to the work area for our team and equipment.
7.2 You are responsible for:
• Ensuring pets are kept away from the work area
• Removing any personal belongings, garden furniture, or valuable items from the work area
• Ensuring we have access to water and electricity if required
• Identifying and informing us of ALL underground services including gas, water, electricity, telecommunications, drainage, and any other buried utilities or infrastructure
• Obtaining any necessary permissions from landlords or management companies
• Providing plans, diagrams, or documentation showing the location of underground services where available
7.3 UNDERGROUND SERVICES - IMPORTANT:
• It is your responsibility to identify and inform us of the location of all underground services on your property before work commences
• We recommend you contact the relevant utility companies to mark out service locations prior to our arrival
• While we will take all reasonable precautions and use appropriate detection equipment where necessary, we cannot be held liable for damage to underground services that have not been disclosed to us or are not accurately marked
• We will make every reasonable effort to locate and avoid underground services, but the accuracy of detection equipment can be limited, particularly with non-metallic pipes or older installations
• If we discover unmarked or undisclosed underground services during work, we will cease work in that area immediately and inform you. Additional costs may be incurred for necessary investigations or alterations to the planned work
• You will be liable for any costs associated with damage to underground services that were not properly disclosed or identified prior to work commencing
7.4 If access is denied or restricted without reasonable notice, we reserve the right to charge for additional costs incurred.
7.5 You must inform us of any health and safety concerns or hazards on site before work commences.
8. MATERIALS
8.1 We will use quality materials appropriate for the work being undertaken.
8.2 While we make every effort to ensure materials are as specified, exact matches for colour, texture, and tone cannot be guaranteed, particularly for natural stone products.
8.3 We will dispose of waste materials in accordance with environmental regulations. Additional charges may apply for excessive waste disposal.
8.4 Materials may be stored on site during the course of the work. We will endeavour to keep these secure, but we cannot accept liability for theft or damage to materials left on your property.
9. WEATHER AND DELAYS
9.1 Landscaping work is weather-dependent. We may need to suspend work during adverse weather conditions (heavy rain, frost, extreme heat) to ensure quality of workmanship.
9.2 We are not liable for delays caused by:
• Adverse weather conditions
• Material supply issues
• Unforeseen ground conditions
• Circumstances beyond our reasonable control
9.3 We will communicate any significant delays to you as soon as possible.
10. WORKMANSHIP AND COMPLETION
10.1 All work is carried out to a professional standard with attention to detail.
10.2 We will leave the site in a clean and tidy condition upon completion, removing all waste materials and debris if that is included in the cost.
10.3 Natural materials (such as stone, timber, and turf) may require settling time. Minor adjustments may be needed after completion.
10.4 Newly laid turf requires appropriate aftercare. We can provide guidance, but ongoing maintenance is your responsibility.
10.5 Timber products will require regular treatment and maintenance to ensure longevity.
11. WARRANTY AND GUARANTEES
11.1 We guarantee our workmanship for a period of 12 months from the date of completion, subject to:
• The work being maintained in accordance with our recommendations
• No alterations having been made by third parties
• Normal wear and tear excepted
11.2 This guarantee does not cover:
• Damage caused by misuse or lack of maintenance
• Natural settlement or movement
• Weather-related damage beyond reasonable expectations
• Damage caused by third parties
• Acts of God or force majeure
11.3 Manufacturer warranties on materials and products are separate and will be passed on to you where applicable.
11.4 Our warranty is non-transferable and applies only to the original client.
12. LIABILITY AND INSURANCE
12.1 We maintain appropriate public liability insurance.
12.2 We will take all reasonable care to avoid damage to your property during the course of our work.
12.3 We cannot accept liability for:
• Damage to underground services that were not properly identified, disclosed, or marked by you prior to work commencing (as detailed in Section 7.3)
• Damage to underground services where detection was not possible due to limitations of detection equipment or the nature of the installation
• Pre-existing damage or defects not caused by our work
• Damage occurring after practical completion
• Loss of plants, trees, or landscaping features not directly caused by our negligence
• Consequential losses or damage
• Delays or costs arising from the discovery of undisclosed underground services
12.4 Our total liability under these Terms and Conditions shall not exceed the total value of the contract.
12.5 You are advised to inform your home insurance provider of any significant landscaping or construction work being undertaken.
13. CANCELLATION
13.1 You may cancel your order at any time before work commences, subject to:
• Written notice being provided
• Payment of any costs already incurred (materials ordered, preliminary work completed)
• Forfeiture of any deposit paid if materials have been specifically ordered
13.2 If you cancel after work has commenced, you will be liable for:
• All work completed to date
• Materials purchased or ordered
• Any costs reasonably incurred
13.3 We reserve the right to cancel or suspend work if:
• Payment terms are not adhered to
• Site access is unreasonably restricted
• Health and safety concerns arise
• You breach these Terms and Conditions
14. HEALTH AND SAFETY
14.1 We adhere to all relevant health and safety legislation and regulations.
14.2 The work area will be treated as a construction site during the course of our work. Please keep children and pets away from the work area for their safety.
14.3 We will make reasonable efforts to maintain site security, but you are responsible for securing your property outside of our working hours.
15. COMPLAINTS AND DISPUTES
15.1 We are committed to customer satisfaction and quality workmanship. If you have any concerns about our work, please contact us immediately.
15.2 Any complaints should be made in writing within 14 days of practical completion.
15.3 We will investigate all complaints promptly and fairly, and will arrange to rectify any genuine defects at no additional cost.
15.4 If a dispute cannot be resolved amicably, both parties agree to attempt resolution through mediation before pursuing legal action.
16. DATA PROTECTION AND PRIVACY
16.1 We process personal data in accordance with UK data protection legislation.
16.2 We collect and use your information only for the purposes of providing our services, including:
• Contact details for communication
• Site address for work completion
• Payment information for invoicing
• Photographs of completed work (with your permission) for marketing purposes
16.3 We will not share your personal information with third parties except where necessary for the provision of our services or where required by law.
16.4 You have the right to request access to, correction of, or deletion of your personal data by contacting us.
17. PHOTOGRAPHY AND MARKETING
17.1 We may request permission to photograph completed work for marketing and promotional purposes.
17.2 If you agree to photography, you grant us a non-exclusive, perpetual licence to use images of the work for marketing purposes, including on our website, social media, and promotional materials.
17.3 You have the right to refuse photography or to withdraw consent at any time.
18. INTELLECTUAL PROPERTY
18.1 Any designs, plans, or creative concepts we produce remain our intellectual property until payment has been received in full.
18.2 You may not use our designs for work carried out by other contractors without our written permission.
19. SUBCONTRACTORS
19.1 We reserve the right to use qualified subcontractors for specialist aspects of the work.
19.2 We remain responsible for the work of any subcontractors employed by us.
20. SEVERABILITY
20.1 If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
21. ENTIRE AGREEMENT
21.1 These Terms and Conditions, together with your quotation, constitute the entire agreement between you and JP Landscaping & Fencing Ltd.
21.2 No variation to these Terms and Conditions shall be effective unless agreed in writing by both parties.
22. GOVERNING LAW
22.1 These Terms and Conditions are governed by the laws of England and Wales.
22.2 Both parties agree to submit to the exclusive jurisdiction of the courts of England and Wales.
